1. Acceptance of these terms

By creating an account or using the ChatMax platform, you confirm that you have read, understood and accepted these Terms of Use. If you do not agree with any part of them, please do not use our services.

These terms apply to every person and business that accesses ChatMax, on any plan and through the web, desktop or mobile app. If you use ChatMax on behalf of a business, you confirm that you are authorized to accept these terms for it.

2. Description of the service

ChatMax is a customer service platform that brings WhatsApp and other channels together in one place, with support for multiple agents, automation, chatbots, artificial intelligence, campaigns and reports.

The features available to you depend on your plan. We may improve, add or discontinue features to make the platform better, and we will let you know about significant changes.

3. Registration and account

To use ChatMax, you must provide accurate information and keep it up to date. Using the official WhatsApp Business API requires an active, registered business that meets Meta's requirements.

You are responsible for keeping your login credentials confidential and for all activity on your account. Let us know right away if you notice any unauthorized use.

4. Use of the official API and Meta's rules

WhatsApp messaging runs through the official WhatsApp Business API, provided by Meta. By using ChatMax, you also agree to follow Meta's policies and the WhatsApp Business policies.

Breaking those policies, for example by sending spam or prohibited content, can lead Meta to restrict your number directly. Those restrictions are outside ChatMax's control.

5. Plans, payments and cancellation

Prices and conditions for plans and Combos are shown when you sign up. Combo implementation is an on-demand service and is not refundable once it has started.

There is no minimum contract term: you can cancel at any time. Meta charges directly for business-initiated template messages, at its current rates, which vary by country. ChatMax does not charge per message.

6. Your responsibilities

You agree to use ChatMax lawfully, in line with the laws that apply to you, the rights of others and your customers' consent to receive messages.

You may not use the platform for illegal, fraudulent or offensive purposes, or in any way that violates privacy or intellectual property rights.

7. Messages, campaigns and compliance

Campaigns and outbound messages must follow Meta's rules and the data protection, privacy and marketing laws of the countries where you and your customers are located. You are responsible for having a legal basis and, where required, consent to contact your customers.

ChatMax provides the tools, but the business using the platform is responsible for the content it sends and for obtaining consent.

8. Intellectual property

The platform, the ChatMax brand, the software, the layouts and the content belong to Grupo Fidelimax and are protected by law. Using the service does not transfer any intellectual property rights to you.

The data and content you add to the platform remain yours.

9. Limitation of liability

ChatMax works to keep the service stable and secure, but is not liable for outages caused by third parties, such as Meta's own infrastructure or internet providers, or by events beyond our reasonable control.

To the maximum extent permitted by law, ChatMax's liability is limited to the amounts actually paid by the customer business for the period in question. Nothing in these terms excludes or limits any liability or rights that cannot be excluded or limited under the law that applies to you.

10. Availability and support

We provide support by WhatsApp and email. Combo customers get priority support during implementation.

We work to keep the platform highly available, with continuous monitoring and ongoing improvements.

11. Changes to these terms

We may update these Terms of Use from time to time. We will announce significant changes through our official channels. If you keep using ChatMax after an update, you accept the new version.

12. Governing law and jurisdiction

These terms are governed by the laws of Brazil. Any disputes will be settled by the courts of the city of São Paulo, State of São Paulo, Brazil, to the exclusion of any other court, however privileged.

If you use ChatMax as a consumer, this clause does not take away any protection you have under the mandatory laws of the country where you live.
