How we collect, use and protect your personal data and your customers' data.
1. Who we are
ChatMax is a product of Grupo Fidelimax, registered in Brazil under CNPJ 10.867.770/0001-90, with its head office at Rua Salvador Simões, 801, 5th floor, São Paulo, SP, Brazil. We are the controller of the personal data we process in connection with your account on the platform.
This policy explains openly how we collect, use and protect personal data, in accordance with Brazil's General Data Protection Law (Lei Geral de Proteção de Dados, or LGPD) and, where they apply to you, other data protection laws, such as the GDPR in the European Union and the United Kingdom and the CCPA in California.
2. What data we collect
We collect registration data (such as name, email address, phone number, company name and business registration number), data about how you use the platform (access logs and activity) and the payment data needed to sign up for a plan.
We also process the content of the conversations and contacts you manage on the platform, acting as a processor, as described below.
3. How we use the data
We use the data to provide and run the platform, verify logins, provide support, process payments, improve our services and send you relevant messages about your account.
We do not sell your personal data or your customers' personal data.
4. Legal bases
We process data on the basis of performing our contract with you, complying with legal and regulatory obligations, our legitimate interests and, where applicable, the consent of the person concerned. These legal bases are provided for in the LGPD and correspond to those set out in the GDPR.
5. Your customers' data
For the contacts and conversations your business manages in ChatMax, your business is the controller of that data and ChatMax acts as a processor, handling it only to make your customer service possible.
Your business is responsible for having a proper legal basis and, where required, consent to communicate with its customers.
6. Data sharing and international transfers
We share data with Meta to operate the official WhatsApp Business API, and with the providers that make the platform work, such as cloud hosting and payment providers, as well as integrations you authorize.
These partners handle the data according to our instructions and security standards, and only for the purposes needed.
ChatMax is provided by a company based in Brazil, and some of our providers, including Meta, operate in other countries. This means your data may be processed outside the country where you live. When that happens, we take the steps required by applicable data protection law to keep it protected.
7. Artificial intelligence and your data
When you turn on the AI, the documents and content you upload are used only to train and run customer service for your own business.
You control what goes into and comes out of the knowledge base, and you can remove it at any time.
8. Cookies
We use cookies and similar technologies for login, security, usage analytics and to improve your experience. You can manage your cookie preferences in your browser.
9. Information security
We use technical and organizational measures to protect data against unauthorized access, loss or alteration, including encryption in transit and access controls.
10. Retention
We keep data for as long as needed for the purposes described in this policy and to meet our legal obligations. When our relationship ends, the data is deleted or anonymized, subject to the retention periods required by law.
11. Your rights
Under the LGPD, you can ask us to confirm whether we process your data, and to access, correct, anonymize, transfer or delete it. You can also withdraw your consent at any time. In Brazil, you may also file a complaint with the National Data Protection Authority (ANPD).
If you are in the European Union or the United Kingdom, the GDPR also gives you the right to object to or restrict certain processing and to lodge a complaint with your local data protection authority. If you are a California resident, the CCPA gives you the right to know, correct and delete your personal information, to opt out of its sale or sharing, and not to be discriminated against for using these rights. Similar rights may apply under the laws of other countries and US states.
To exercise your rights, contact us through the channels listed in this policy. We may need to confirm your identity before acting on a request. If your data was provided to us by a business that uses ChatMax, we may refer your request to that business.
